Terms Of Use

The terms and conditions apply to users of the Cradle Cribs and Kids website. When purchasing from this site, you accept and agree to these terms. We suggest that you read the terms and conditions detailed below as this forms the basis of the sale agreement between you and Cradle Cribs and Kids. If you proceed with your purchase, you are acknowledging that you have read and understood these terms and conditions.

Payment & Pricing
Payment for your order is required at checkout.

All prices are listed in Australian Dollars and include GST. The prices indicated exclude delivery and handling. Prices are subject to change without notice. Cradle Cribs and Kids will at all times use our best efforts to ensure that the prices on our website are accurate at any point in time. The prices that are displayed on the website are current at that particular point in time and we reserve the right to change our prices at any time without prior notice. If/when price changes occur, it will be automatically updated on the website.
We accept payment via Visa and MasterCard, including credit cards and debit cards, Oxipay, Afterpay and PayPal. If placing an order from outside of Australia, your card may have international purchasing restrictions, please get in touch with us via our contact page to make payment arrangements.

Your purchase is protected by Trustwave the largest Credit Card provider and PayPal.

No credit card information is shared by this site.

Product Availability & Order Process

Cradle Cribs and Kids offer a large range of baby products to our customers. Due to a number of factors (including space, turn over, supplier availability, colourway and more) we may not have stock of all products advertised on our website. Our checkout will enable you to order a product that is out of stock – this means your Order is held in dispatch until the order is complete.

In the event that you place an order a product that is out of stock in our warehouse, we will endeavour to ship your item/s within 14 business days. Some items, such as furniture may take up to 12 weeks for delivery. In the event that your order will take more than 14 business days to be dispatched, we will contact you with an estimated dispatch date. If necessary, we may offer you an alternative item of equal value.

Please ensure you allow enough time for your order to arrive.

Complete Orders

A Complete Order is an order, which has all products within that order ready for dispatch.

Incomplete Orders / Backorders / Special Orders

An Incomplete Order, Backorder or Special Order is an order in which one or more items may not be in stock at the time of order. If a product within an order is out of stock, the remaining order will be held in our warehouse until the outstanding product arrives to us. This includes products that we do not keep in stock and are ordered directly through our supplier. This includes but is not limited to furniture and mattresses. Due to size and space requirements, we do not keep all furniture items or mattresses in stock.

Delivery Policy

We ship Australia-Wide excluding some remote locations. We ship to physical residential and business addresses  only, we cannot ship to PO Boxes or Parcel Lockers.

Delivery Costs

Delivery and handling costs are calculated in the shopping cart and will be added to the order total before checkout and cannot be discounted.

Orders under $100 attract a $15 postage and handling fee, orders over $100 are charged $25.00 for postage and handling.

Orders for furniture will need to have delivery costs calculated separately based on size, weight and destination. Please get in touch with us via our contact page for further information and/or a quote.
Delivery Times

Cradle Cribs and Kids will endeavour to process and dispatch Complete Orders from our warehouse within 14 business days, however due to circumstances out of our control this may not occur (ie. If you have purchased Furniture, Backorder or Special Order items).

Orders are dispatched from our warehouse in the Illawarra (South Coast of NSW). Delivery times depend on your location within Australia and with whom your order is shipped.

Delivery Tracking

The delivery service of your purchase is determined at the discretion of Cradle Cribs and Kids and depend on the size and quantity of products ordered and the address to which the products will be delivered to.

You can track your parcel via the relevant courier websites, using the consignment number provided to you by email at dispatch stage. Please allow up to 24 hours for your tracking number to show any information.

Accepting Deliveries

It is necessary for someone to be available to accept delivery as we use a courier service. For your convenience and as delivery couriers cannot call prior to delivery, we recommend having your order sent to your work address or to an alternative address if being at home during business hours is not an option.

If no one is available at the delivery address to sign for the delivery, you agree that the contents of that order will be left at the address in an appropriate place (also known as Authority To Leave or ATL). In the instance where the courier deems that it is too unsafe, where there is no assistance for large or bulky items or that there is a potential for theft, they may leave a card to advise you of attempted delivery. You will be required to call the phone number on the card to organise pickup from the courier depot or a re-delivery. Any re-delivery charges are to be paid by the purchaser and not Cradle Cribs and Kids.

Please note: in an instance where no one is available at the delivery address, and the goods are left at the premises, the title to the goods are transferred to you, and any occurrence for damaged, lost or stolen items are not covered and warranty is void.
Products Lost Or Damaged In Transit

Items purchased from Cradle Cribs and Kids webshop are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon dispatch from the Cradle Cribs and Kids warehouse. We take great care when packaging your order and rarely have our packages been damaged in transit.  We advise for you to inspect all cartons and confirm the contents of all packages at the time of delivery.

If goods appear damaged, we advise for you to not sign for goods, reject the delivery (take photos if possible) and to contact us via email at sales@cradlecribsandkids.com.au within 24 hours of attempted delivery for us to help rectify the issue for you.

If goods are signed for at the delivery address, you are therefore are accepting the delivery in good condition and you waive the right to compensation by Cradle Cribs and Kids, the supplier and the applicable courier service – including but not limited to repair, replacement goods or refunds.

Small items and items that are quantity packed may be repackaged, please don’t be worried if your car seat arrives in another box. If you believe you are missing items and have multiple items on your order, ensure you inspect all boxes.

In some cases, items may be split during delivery by the couriers and this is out of our control. Generally your other parcels should arrive within 2 business days of your initial delivery. If this does not occur, please contact the courier service with your tracking number prior to contacting us.

If you believe your order has been lost in transit – ie. your tracking number has advised your order has been delivered, please email us at sales@cradlecribsandkids.com.au with your concern and order number. We will lodge an investigation on your behalf to the applicable courier service. Investigations usually take up to 2 weeks to finalise, depending on circumstances, some may take longer. Please be advised that Cradle Cribs and Kids cannot redeliver a new order or refund you until the investigation is finalised.

Please note that although we can lodge an investigation on your behalf, Cradle Cribs and Kids are not responsible for compensation to you, of any sort, due to loss of orders or damaged items when goods have been left without a signature (ATL).

Product Care Policy

Order Cancellations

Your order is considered current unless cancelled in writing (via email) by you. All order cancellations incur a 20% cancellation fee, excluding furniture orders which incur a 50% cancellation fee. Cancellation fees apply to goods only, shipping charges, where applicable will be refunded in full. Orders cannot be cancelled once they have been dispatched.

We will cancel, without any cancellation fee, any duplicate order made by you. We must be advised, by you (via email|), within 24 hours of the duplicate order being placed and before your order is dispatched from our warehouse.

Returns

Where you have purchased a physical product from our webshop that satisfies one of the following circumstances, we will gladly arrange a replacement, exchange or credit.

1. The product proves faulty within 14 days of receipt

2. The item does not match the description provided when sold on our website

3. The product received is not the product ordered

4. The product is damaged in transit

Please contact us within 24 hours of receipt (by email to sales@cradlecribsandkids.com.au) of the product to advise of the issue.

To return an item:
1. The item must unused, in its original packaging (packaging must in no way be damaged), hygiene and security seals intact where applicable and be in resalable condition (product to not have been opened, used, washed, worn or have any odour).
2. Include a copy of the email from Cradle Cribs and Kids confirming approval of your return, including a copy of your receipt and a contact email address.
3. Return the item back to us within 7 days of receiving the product, ensuring that the item is packaged so the product is not damaged in transit back to us otherwise a return may be refused. Note that we suggest you return the product by receipted or express post as we cannot be held responsible for any product lost or damaged in transit.
4. Address to: Cradle Cribs and Kids, Shop 1, 20-22 Marshall Street Dapto NSW 2530 within 7days of receiving the item.
5. The cost of return delivery for the product is your responsibility.
6. Once we receive the returned product, allow 3 business days for us to inspect the product, after which time we will be in touch regarding the outcome of your return

Please note that we do not accept returns on Special Orders, personal hygiene products (underwear, swimwear & toiletries), breast pumps, products without security seals (baby wash etc) and car seats. Furniture items incur in a 20% restocking fee. Unfortunately we do not offer refunds due change of mind or incorrectly ordered items.

Incorrect Goods Supplied

In the unlikely event that we supply you with an incorrect product, you must email us with your order number, the product ordered and the product received to sales@cradlecribsandkids.com.au, within 24 hours of delivery. We will endeavour to rectify the issue as soon as possible.

To process a return for incorrectly supplied goods:
1. Email us at sales@cradlecribsandkids.com.au with your order number, a description of the product you ordered and a description of the product you received.

2. We will advise you by return email what the next step is which is on a case-by-case basis.

Depending on the situation, you may have to send the incorrectly supplied product back to us. We will advise you which method, in which to do so and at our discretion, Cradle Cribs and Kids will reimburse you for the cost of sending the product back to us. Other forms of delivery or upgrade of delivery services, not approved by us will be at your cost. The incorrectly supplied product/s must be unused, in its original packaging (packaging must in no way be damaged), hygiene and security seals intact where applicable and be in resalable condition.

Faulty Products

To process a claim for a faulty product:
1. If products are found to be faulty as a result of a manufacturing defect, you must contact us within 24 hours of delivery for us to help rectify the issue for you.
2. The product must not have been used or washed.
3. Email us at sales@cradlecribsandkids.com.au, with your order number, a description of the issue, a photo of the faulty product, a photo of the packaging and your complete contact details including contact email. Note that if the product shows damage on the exterior packaging, this is usually due to damage in transit – if the products have been signed for, you are therefore accepting the delivery in good condition and you waiver the right to compensation from us, the supplier and the applicable courier service – including but not limited to repair, replacement goods or refunds.
4. We will advise you by return email what the next step is which is on a case-by-case basis.

Cradle Cribs and Kids and its supplier’s reserve the right to assess the condition of the faulty goods prior to offering a repair or replacement. We will do to the best of our ability to advise of the most economical means to have the issue resolved in a timely manner. This may result in the product needing being sent back to us, approved repair agent or supplier for assessment, with all costs for transporting the faulty item for assessment being incurred by you.

If deemed to be a manufacturing fault, the product or part will most likely be repaired or replaced. In the case where a product or part cannot be repaired or replaced, we may offer you a refund on the product or part.

Warranties

All products sold online include a standard warranty, unless otherwise stated. Warranties can vary between 6 months to 5 years depending on the product purchased. Warranties cover for manufacturing faults only and do not cover misuse or wear and tear, please see your product manual for full warranty inclusions as they differ between products.

For a Warranty Claim after the first year of purchase, please contact the supplier directly with your concern.

To process a Warranty Claim within the first year from purchase date:
1. Email us at sales@cradlecribsandkids.com.au, with a copy of your receipt, a description of the issue, a photo of the faulty product/issue and your complete contact details including contact email.
2. We will advise you by return email what the next step is which is on a case-by-case basis.

Cradle Cribs and Kids and its supplier’s reserve the right to assess the condition of the faulty goods prior to offering a repair or replacement. We will do to the best of our ability to advise of the most economical means to have the issue resolved in a timely manner. This may result in the product needing being sent back to us, approved repair agent or supplier for assessment, with all costs for transporting the faulty item for assessment being incurred by you.

If deemed to be a valid warranty claim, the product or part will most likely be repaired or replaced. In the case where a product or part cannot be repaired or replaced, we may offer you a refund on the product or part. Please note that there is no warranty included on Gift With Purchases (GWPs) or free products.

Cradle Cribs and Kids update this website regularly; however we make no representation as to the accuracy or completeness of any information or services of the website. All information and services are provided on the basis that you undertake the responsibility for assessing at your own risk.

We may from time to time, change or add content to this website (including our Terms and Conditions) without notice. We are not liable to you or anyone else if errors occur in the information on our ebsite or if that information is not up-to-date. At all times we will try to ensure that the images and content on our website are as accurate and as close to the actual product as possible. It is essential that you use the actual written description of each product when deciding to purchase a product from Cradle Cribs and Kids.

Cradle Cribs and Kids endeavours to ensure the accuracy of our website pricing and content; in the case of a technical based pricing or content error, we reserve the right to cancel or refund the mistaken price to you without notice. If you come across what you believe to be a technical error or inaccuracy of our content, please notify us at sales@cradlecribsandkids.com.au.

Privacy Policy

Cradle Cribs and Kids is dedicated to keeping your details private. Any information, we collect in relation to you, is kept strictly secured. We do not pass on/sell/swap any of your personal details with anyone. We use this information to identify your orders, provide you with our newsletter and to personalise your shopping experience with us. Cradle Cribs and Kids uses cookies to allow you to login to your account, maintain a shopping cart and to purchase items in your shopping cart. Cookies sent to your computer from Cradle Cribs and Kids only last while you’re browsing our website. We do not store persistent cookies on your computer. Cookies also allow us to give you a more personalised shopping experience by displaying products that interest you throughout our product pages, thus providing you with a more friendly, interesting and enjoyable shopping experience.

In order for Cradle Cribs and Kids to fulfil an order you may place via our website, it is necessary for us to collect certain information from you. The type of customer information we ask for includes name and address for billing and delivery purposes, day phone number, email address, and product preferences. Cradle Cribs and Kids takes the issue of our customer’s privacy seriously, and has taken the appropriate measures to ensure with confidence that any information given to us by our customers is protected. We recognise the sensitivity of your personal information and will never share your details with any other organisation.

Disclaimer

Cradle Cribs and Kids will not be liable for any indirect, incidental or significant damages or loss including but not limited to loss of income, loss of use, loss of property, loss of business or profits howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise. To the extent permitted by law, Cradle Cribs and Kids does not accept any liability for any damage or injury caused by the use or misuse of products purchased from Cradle Cribs and Kids.

To the extent that Cradle Cribs and Kids may be liable for a breach of a condition of The Trade Practices Act 1974 (other than a condition or warranty implied by section 59 of the Act), the maximum aggregate liability for any product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the product(s) in question. Any transactions on this website and all legal aspects associated with this site will fall under jurisdiction of the laws of New South Wales, Australia.
